County Commission Minutes 01/13/03
A continuation of a previous meeting of the County of Dukes County Commissioners was scheduled for Monday, January 13, 2003 at 6:00 p.m. in the Conference Room of the County Administration Building, notice of such meeting having been posted as required by law.

Commissioners Present: John Alley,  Chairman; Leslie H. Leland, Leonard Jason, Jr.; Roger Wey; Robert Sawyer; Nelson Smith and Paul Strauss
Also Present: Dianne Powers, Deputy County Manager; Marsha Smolev, Executive Assistant; Sheriff McCormack; Noreen Flanders, Treasurer; Woodrow Williams; Ezra Blair, MV Times; Joanna Jernegan; David Kann; Herb Putnam; Steve Berlucchi, County Engineer and Jonathan Burke, Gazette.
Continuation of Meeting of January 8, 2003:
Commissioner Alley stated that at 5:53 he received a letter from Carol Borer.  Ms. Powers read the letter into the record.

Ms. Powers stated that Michael Gilman wrote to Attorney Beach requesting an extension for Beach’s request under the Public Records Act for information.

Ms. Powers also stated that she had met with the Sheriff and the Treasurer and came up with a list of needs to be addressed immediately.  Ms. Flanders added that they forgot to add the issues of the leaks in the two buildings.  Cape Cod Builders were supposed to get the leaks fixed the week after Christmas. There was discussion as to whether this would cost the County money.  Steve Berlucci said there were no costs involved but the work needs to be scheduled scheduled.

Commissioner Wey made a motion to accept Ms. Borer’s letter to terminate her Certificate of Employment. Commissioner Sawyer seconded the motion. Vote was unanimous.

The Commissioners made a motion to go into executive session and not reconvene in open session for the purpose of continuing discussion of possible litigation, including complaints about an employee arising from a letter dated December 24, 2002, received from Attorney Ana Gomez-Blanchfield, as well as a letter received by County Attorney Michael Gilman, from Attorney James F. Rogers, II, dated January 12, 2003. It is requested that Dianne Powers be in attendance as Acting County Manager/ Recording Secretary.   Role call vote: John Alley, aye; Roger Wey, aye; Leonard Jason, Jr., aye; Nelson Smith, aye; Paul Strauss, aye; Leslie Leland, aye; Robert Sawyer, aye. Vote carries.
